Emilie Kiser’s Husband Brady Kiser Won’t Be Charged Over Son Trigg’s Death

More details have come to light surrounding Trigg Kiser’s tragic death.

Nearly three months after influencer Emilie Kiser and husband Brady Kiser’s 3-year-old son died from an accidental drowning in the family’s pool, police reports alleged that Brady, who was home with Trigg and their 3-month-old Theodore, placed a $25 sports bet around the time of the incident.

According to a report from the Chandler Police Department (CPD), a basketball game between the Boston Celtics and the New York Knicks was playing on the television as officers arrived to the family’s home.

During an interview with authorities at the time, per the report, Brady said that the game was “not where my focus was, it was on my baby.”

Cell phone records that detailed a correspondence between Brady and the online sports betting company DraftKings later showed, per the report, that the 28-year-old had allegedly placed a $25 wager on Celtics player Jayson Tatum around the time of his son’s drowning.

The report went on to state that the toddler “was in the backyard unsupervised for more than 9 minutes, and in the water for about 7 of those minutes. Brady’s statements do not match what is seen on the video; he did not accurately describe one thing [Trigg] did after he went outside.”

“This leads to the conclusion that Brady was not aware of what [Trigg] was doing and was not watching him,” the report continued. “The combination of these factors led to [Trigg] drowning, and a remedy to any of the contributing circumstances could have prevented the outcome.”

Following the investigation surrounding Trigg’s untimely passing, however, officials stated that Brady won’t be charged in relation to the incident.

“Maricopa County Attorney Rachel Mitchell announced today that Brady Kiser will not be charged in the drowning death of his son,” the Maricopa County Attorney’s Office said in a statement on its website July 25, “because there is no reasonable likelihood of conviction.”

And while the attorney’s office acknowledged that the CPD previously recommended a Class 4 felony charge of child abuse against Brady, they said further research showed that there wasn’t enough evidence to prove the crime. 

“Surveillance video from outside the home showed how the drowning occurred and the actual timeline of events,” the statement continued. “In order to convict a person of this charge, the state has to prove beyond a reasonable doubt to a unanimous jury that the person failed to perceive a substantial and unjustifiable risk, and that failure to perceive the risk was a gross deviation from the standard of care a reasonable person would show.”

The statement concluded, “After careful review of the evidence submitted by Chandler PD, it was determined this case does not meet that standard.”
